RFID GATE ACCESS TERMS AND CONDITIONS
(Adopted by the Board of Directors)

  1. PURPOSE AND AUTHORITY
    These Terms and Conditions govern the issuance, use, and management of RFID tags and any other vehicular access devices (“RFID Tags and Access Equipment”) for the Lake Sheen Reserve front gate system. These Terms and Conditions are adopted pursuant to the Association’s authority under the governing documents, including Article IV, Section 2 of the Declaration, and the Board Resolution Adopting the Rule and Regulation Regarding Gate Access.
  2. ELIGIBILITY FOR ISSUANCE OF RFID TAGS
    2.1 Vehicle Information Requirement
    Owners must provide all vehicle information required by the Board, including but not limited to: license plate number, VIN number, make, model, year, color, name of legal owner of the vehicle, a copy of current registration, and proof of insurance. Failure to provide or update required information constitutes a violation of these Terms and Conditions.

2.2 Authorized Vehicles Only
RFID Tags and Access Equipment will only be issued for vehicles registered in the name of the Owner or an immediate family member who resides with the Owner.

2.3 Lawfully Operable Vehicles
RFID Tags will not be issued for any vehicle that is not currently registered, does not have valid license plates, or cannot be lawfully operated on public roads.

  1. PROHIBITED USE
    3.1 No Transfer to Non-Residents
    RFID Tags may not be given, loaned, transferred, or otherwise provided to non-residents, guests, vendors, contractors, or any other third parties under any circumstances.

3.2 Non-Transferrable
RFID Tags are assigned to the specific vehicle for which they are issued and may not be moved or reused on another vehicle without prior Board approval and updated documentation.

3.3 Misuse
Any attempt to circumvent gate security, provide unauthorized access, or misrepresent vehicle information constitutes a violation of these Terms and Conditions.

  1. OWNER RESPONSIBILITY
    Owners are responsible for ensuring the RFID Tag remains on the authorized vehicle, notifying the Association if the vehicle is sold, replaced, totaled, or otherwise removed from service, paying any applicable replacement fees, and ensuring all household members comply with these Terms and Conditions.
  2. ENFORCEMENT AND PENALTIES
    5.1 Violations
    Violations include refusing to submit required documentation, providing false or incomplete vehicle information, providing RFID Tags to non-residents, using RFID Tags on unauthorized vehicles, or any other action inconsistent with these Terms and Conditions.

5.2 Deactivation of RFID Tags
Failure to comply with these Terms and Conditions shall result in the immediate deactivation of the Owner’s RFID Tag or Tags at the gate. Deactivation may apply to one or all RFID Tags assigned to the household.

5.3 Additional Remedies
The Association reserves the right to impose fines as permitted by Florida law and the governing documents, require reapplication before reactivation, or pursue any other remedy available under the governing documents or Florida law.

    Issuance, possession, or use of any RFID Tag or Access Equipment constitutes acknowledgment and acceptance of these Terms and Conditions.
